In Republic of Serbia, a trade mark can be – a figurative element alone, a combined mark, label, word mark, mark comprised of colors or numbers or letters, 3D or a music mark.

Republic of Serbia is part of Madrid Protocol, so TM applications can be filed in two ways – directly or via WIPO. In any case, in Serbia, the IPO ex officio examines each application for absolute but also for relative grounds for refusal, opening the possibility of opposition proceedings only after this examination. This is a new development from February 2020.
Local IPO can therefore issue Official Actions if not all conditions for registration were fulfilled and the owner is given time to respond (using a local representative) to possibly remove the obstacles to registration.
